PUBLIC HEARING TUESDAY, JANUARY 10, 2017 6:45 P.M.
Council President, Lynette Richards called the Public Hearing for Rezoning Parcels from Heavy Industrial to Residential to order at 6:45 p.m. Present were council members Tom Crowe, Jason TePaske, Mike Canaday and Ken Hicks. Also present: Mike Mosley and Cynthia Anderegg. Absent: Delton Thorson, Ken Hicks and Kim Krueger
Motion by Crowe seconded by Canaday to adjourn. Motion carried.

CITY COUNCIL MEETING TUESDAY JANUARY 10, 2017 6:50 P.M.
Council President, Lynette Richards called the regular meeting of the Augusta City Council to order at 6:50 p.m. Present were council members Tom Crowe, Lynette Richards, Jason TePaske, and Mike Canaday. Also present were Mike Mosley and Cynthia Anderegg. Absent: Delton Thorson, Ken Hicks and Kim Krueger

APPROVAL OF AGENDA Motion by Crowe seconded by Canaday to approve the agenda. Motion carried.
APPROVAL OF MINUTES
Motion by Crowe seconded by TePaske to approve the December 13, 2016 regular council meeting minutes. Motion carried.
PUBLIC COMMENT None
APPROVAL OF DEPARMENT REPORTS
Motion by Crowe seconded by Canaday to receive the Treasurer’s Report. Motion carried.
Motion by Crowe seconded by TePaske to approve the Police Department Report. Motion carried. Motion by Canaday seconded by TePaske to approve the Senior Center Report. Motion carried.
Motion by Crowe seconded by TePaske to approve the Library Report. Motion carried.
Motion by Crowe seconded by Canaday to approve the Public Works Department Report. Motion carried.
DISCUSS AND CONSIDER PLAN COMMISSION’S RECOMMENDATION TO REZONE PARCELS LOCATED AT RAILWAY STREET
Motion by Crowe seconded by TePaske to accept the recommendation of the City Plan Commission to rezone Parcel ID#s 202-1079-09-000, 202-1109-09-000, 202-1110-04-000, and 202-1110-06-000 located at 324 Railway Street from Heavy Industrial to R-1 Residential per request of property owner Annette Reetz. Motion carried.
UPDATE ON SALE OF PROPERT AT 324 RAILWAY STREET
The sale of the property at 324 Railway Street and adjoining parcels closed on December 30, 2016 for the bid amount accepted from Annette Reetz and Bernie Buttke at the June 14, 2016 council meeting ($59,000) less required closing costs. Payment in the amount of $58,268.00 has been received.
UPDATE ON CITY OWNED RENTAL PROPERTY
The council discussed options to collect past due rent on from the previous tenant of 324 Railway Street, and the current tenants for both the East and West Library apartments.
Motion by Canaday seconded by Crowe to instruct the City Attorney to send a letter to Bernie Buttke to set up a payment arrangement by the February Council meeting If arrangements are not made, the council will file legal action seeking judgement to collect the past due rent in the amount of $7,600. Motion Carried.
Motion by TePaske seconded by Crowe to have the clerk send letter to Mark Lone (East Library apartment) to have a payment arrangement in place by the February Council meeting or the Council will move forward with eviction. Motion carried.
The West Library apartment was rent for office space by Corey Bauch and Chad Johnson. The apartment was out dated and not up to code. They spoke to Kim Krueger about remodeling, and repairing the electrical and plumbing in lieu of rent for the cost of the repairs. The expense was higher than original anticipated (approx. $15,000). Bauch and Johnson make rent payments starting in January 2017.
This will be reviewed and discussed at the February 2017 Council meeting.
APPROVE BARTENDER LICENSE APPLICATIONS
No motion was made for the bartender’s application for Brandon Hazard, Express Mart.

Motion by Crowe seconded by Canaday to adjourn the meeting.
